題名:我國廉政組織趨同之探討--以調查局及廉政署為例

在全球化及國際競爭壓力之下,各國有關政經社文的政策很難不受影響,於是在政策相互學習及模仿的驅動下,逐漸產生組織趨同的現象。以我國成立的法務部廉政署而言,其成立背景就受到鄰近新加坡及香港良善防制貪腐治理成效的驅使,再加上國內政治民意及反貪問題壓力的需求,在研擬將近十多年後終於2011年7月成立專責肅貪機構,此乃關鍵的歷史時刻。回顧過去有些利害關係人反對成立廉政署的緣由,係因為我國已有不少類似防制貪腐的組織,例如法務部調查局、高檢署特偵組及法務部政風司等,但是推動後的防制成效仍不為民眾所滿意,所以在內外壓力下冀圖成立專責的廉政機構以對應時境的變化,只是這樣的作為是否可以有效達成肅貪使命仍有待時間檢證。因此,本文係針對法務部調查局與法務部廉政署進行剖析,釐清相互間的關係,解離出各自的特性,尋找可能的組織衝突及協力問題,再提出可能的解決方案,以真正達成廉能政府的政策目標。嗣經比較與分析之後,本文提出六點建議,包括組織成功取決於領導者的反貪決心,組織職能的明確化,制度學習的再思,組織成員的中立信守,組織績效及反貪工具的強化,以期組織預期的政策目標――廉能政府可以實現。
The cultural, economic, political and social policies of every nation could not remain impervious to the pressures of world globalization and international competition; hence, propelled by reciprocity in learning and emulation of policies, a trend for policy convergence gradually emerged. Our nation’s Agency Against Corruption (AAC) of the Ministry of Justice was eventually established in July 2011 after deliberation for more than a decade. The establishment of AAC, whose organizational background had been strongly influenced by the fine bribery and corruption preventive governance effectively practiced in Taiwan’s neighboring countries, such as Singapore and Hong Kong and dictated by the political sentiments and anti-corruption demands of the nation, marked a highly significant moment in the nation’s history. In the past, opposition of certain interest groups to the organization of an anti-corruption agency had stemmed from the unsatisfactory policy implementation performances of similar bribery and corruption fighting bodies established by the government; such as, the Investigation Bureau of the Ministry of Justice, the Special Investigation Division of the Taiwan Supreme Prosecutor's Office, and the Department of Government Ethics; hence, it was under the pressure of internal and external forces that the organization of a dedicated corruption fighting body to cope with changes in the demands of the time was planned. However, whether such endeavor would effectively eliminate corruption in the government is something that only time could prove. In light of comparative and analytical study on the organizations, the paper presented six recommendations; including, the fact that success of the organization shall be subject to the leader’s determination to fight corruption, the specification of the organization functions, reconsideration of the system transplantation, commitment of the organization members to remain impartial, and reinforcement of the accountability to action and anti-corruption tools of the organization. It is hoped that through which the organization may achieve its intended policy objective, that is, the realization of a clean government.
