社會法治國原則主要在要求立法者實現制憲者之委託。透過行政、立法及司法 三權之合作與制衡，保障與實現人民具人格尊嚴之自由權與平等權，以達社會正義 與社會平等之理想境界。為達上述憲法精神，立法者應立法建構社會安全制度，以 確定人民基本權利與自我之實現。社會安全制度之首要為社會保險制度，依據社會 保險保障之範圍，我國已先後實施全民健康保險、職業災害保險、就業保險及老年 （退休）年金等制度，目前亦正研議長期照護保險。
