The Constitution of the Republic of China specifies the nation should protect people's right to work. Therefore some hold that the nation should provide employment opportunity and employment protection to unemployed labors to fulfill the responsibility of protecting people's right to work. However some argue that even though the nation has the responsibility to provide employment opportunity, and in the absence of the above or the unemployed labors fail to land a job through employment service, the nation should offer vocational training, so as to increase the opportunity for re-employment, instead of giving unified unemployment payment. As the nation's financial condition is not in a good shape, it's advisable to focus limited resources on areas which require utmost attention. This study, based on the nature of right to work, attempt to analyze related international and local regulations on the protection of right to work. It also offers concrete suggestions for reference in mapping out related laws and regulations on unemployment payment when the government is not able to provide employment opportunity.
