題名:持續犯犯罪成因及其矯正處遇對策之研究

持續犯罪乃發展犯罪學亟欲解答之問題,更是刑事司法體系重要之研究議題。本研究以發展理論及生命史研究為理論基礎,參酌國內外相關實證研究結果,建構研究架構,探討持續犯之成因及現象,並彙整歸納各國機構內、外矯正處遇機制,提出對持續犯犯罪預防及矯正處遇之建議,俾供決策當局規劃擬訂持續犯預防與處遇對策之參考。本研究採取縱貫性研究方法,以2004年問卷調查7所監獄之假釋出獄人960名之資料為基礎,進行長達11年追蹤調查,並與官方再犯資料加以分析比對,期能深入探討持續犯之特性及影響因子。
本研究發現:有效樣本897人共犯下4,090次罪行,未再犯者計有364人,間歇犯計有330人,持續犯計有203人(占22.6%),犯罪次數卻占78.5%,符合「80/20法則」;高達87.2%之持續犯在30歲前即有第一次犯罪紀錄;29歲以下者間歇犯與持續犯/未再犯之比值為60歲以上者之7.5倍;出獄後2年內僅25.9%有再犯紀錄,觀察追蹤11年則有59.4%有再犯紀錄,是追蹤2年再犯情形之2.3倍。最能預測再犯狀況之因子為性別、初判年齡、竊盜有無、毒品有無及家庭支持等5個因子,其中毒品有無與竊盜有無為最具區別效果及預測力之因子。區別持續犯之主要因子為毒品有無、竊盜有無、初判年齡、遊樂生活型態等4因子;而毒品有無、初判年齡、性別、竊盜有無、家庭支持等5因子,則對假釋存活時距具顯著預測力。另,毒品有無、竊盜有無、自陳偏差、通信頻率、接見頻率、婚姻狀況等6因子,對再犯次數具顯著預測力。
根據上述結果,本研究提出總體思維、新收階段、處遇階段及復歸階段等面向之建議,俾供決策當局規劃擬訂持續犯預防與處遇對策之參考。
