本文藉由評述臺北高等行政法院關於公務人員退休之個案判決，以探討現行我國公務人員退休制度(特別是公務人員之命令退休)，其內容包括：(一)退休公務人員之範圍:即依法任用並為現職人員者;(二)公務人員退休之種類:即自願退休及命令退休;(三〉公務人員退休金請求權之法律性質等。其次，本文係就上述所列各項內容從學術之觀點簡評前開臺北高等行政法院之個案判決，並提出本文之結論及建議。

　　The paper is to investigate the situations of current civil servants' retirement in particular to authoritative retirement on the basis of the specific adjudicate made by Taipei high administrative court. We will discuss: 1) The domain of civil servants’ retirement, which merely applies to present employments; 2) The sorts of civil servants, which refer to authoritative and voluntary retirements; 3) The legitimate attributes of pension requests. The paper makes suggestions for this particular adjudicate in terms of academic viewpoints and criticisms.
