在台灣的半總統制之下，總統具有任命行政院院長的權力，是實權的國家元首。然而，迄今為止，學術界對於總統在法案推動上的角色和行為，缺乏實證性的研究，對於總統在立法和政策決定的實務行為所提供之訊息較為有限。有鑑於此，本文以馬英九總統在2008至2012年的經驗為例，探討我國總統的法案推動和立法上的影響力之表現。作者試圖將我國總統的立法推動行為放置在「總統優勢的半總統制」之憲政架構，以及國民黨的黨政關係型態下來理解。由於學術界對半總統制下總統立法推動行為，尚未發展出成熟的研究設計和測量方法，所以作者不揣淺陋，嘗試進行首次的探索。本文在方法上兼採量化和質化分析。作者在文章中首先就總統曾經表達過立場（偏好）的法案加以蒐集，系統性的歸納總統表達的場合或機制類型，並分析不同機制下的偏好強度，再析論其理論意涵。而後，進一步在此基礎上，觀察總統表達偏好法案的通過情形，特別是態度較強烈的法案，同時也分析總統對法案實質內容的影響情形。由於馬總統執政期間歷經不兼任及兼任國民黨主席的不同階段，因此「是否兼任黨主席」這項因素，也可供觀察國民黨黨政關係下總統法案推動的相關變化和影響。
The president under Taiwan's semi-presidentialism is not a ceremonial head of state. On the contrary, he or she has considerable powers, including the power to appoint the premier. However, until now, there has been no paper exploring the president's role in the law-making process, allowing us to learn very little about the president's decision-making behavior. Based upon the experiences of President Ma Ying-jeou in 2008-2012 this paper tries to explore this question to improve the understanding of the role of the president beyond the words and design of the formal constitutional structure. The author first systematically explores the President's preferences of all important bills, and analyzes the mechanisms of the preference-making and the strength of his preference on each bill. Then this paper tries to observe the influence of the President's behavior on the law-making. Finally, the President may or may not be the chairman of the ruling party, so this factor is analyzed in relation to the central question as well.
