國籍與效忠是個包含著國族神話、血統、共同歷史與命運，公
民身分、以及政經權利等要素隱喻的豐富規範語言。而這些要素的
內涵，必須由市民社會藉助公共論辯來產生與確定。由於在近代歷
史上主權的不斷更迭，國籍與效忠，一直不屬於被宰制的台灣人民
公共論辯的話題。即使在威權體制崩解後，支撐國籍與效忠規範背
後的國族意識，也沒有如預期地和緩呈現；各族群競相藉由感官政
治搶奪國族資源，以及感官化選舉所炮製出的多元文化價值，使得
國籍以及公民身分的正當性基礎－血統、國族共同歷史與記憶、選
民意識與公民品德，完全失卻其在規範上的地位與價值。同樣的，
效忠這個總結國族主義的規範支點，也瞬間被棄置在政治不正確的
光譜裏。
由於台灣的全面準市民民主化，新憲法的制定，以及其制定過
程中豐富的公共辯論，將會是重建國族主義以及其必然衍生物－國
籍與效忠規範的新起點。為提供未來公共論辯之部分基礎，本文嘗
試藉由比較包括美加與歐洲國籍規範之方法，探究國籍與效忠規範
背後之個別組成要素之形成背景與內涵，並對台灣國籍要素之現狀
與發展，提出批評與展望。
Nationality and allegiance are, among other things, the most visible
infrastructure of modern Nation-States. The consciousness and
regulations of which are based upon elements with sophisticated
metaphors, such as national mythology or epics, blood, manipulated
history and common fate, citizenship, and the formation and subsequent
transformation of which are usually through the constant discourse
among citizens in the public forum. With the process the legitimacy of
nationality and allegiance is retained and sustained on the basis of
constructive nationalism.
For decades Taiwanese were deprived of the chance to formulate
their own consciousness and regulations over nationality and allegiance
due to the constant hand-over of their national sovereignty among
hegemonies. The consequence proved to be severe even after the
incidental brought-down of totalitarian regime contemplating current
chaotic constructions of the idea of nationality, which is further
undermined by the constant struggle among ethnic groups over the State
power outrageously supported by the government.
A reconstruction and reinterpretation of nationality and its essential
elements is of imminent necessity while a total acquisition of State
authority by the semi-civil society of Taiwan would be achieved with the
drafting of the Island’s new Constitution. This article is therefore
intending to provide an overview towards the consciousness of
nationality and allegiance by way of comparing the related Canadian and
European context, so to serve as a partial basis for the coming public
discourse over these issues.
