提要內容:
隨著晚近全球性政治、經濟與社會之快速變遷,公共行政的理論與實務界皆意識到公共服務之性質亦無可避免面臨劇烈之轉變。首先,就公共行政所面對的外在環境而言,市場化、全球化與資訊網路技術的興起,將造成傳統公共服務之價值與管理哲學面臨重大之考驗。復次,就公共行政的內在環境而言,面對政府民營化、彈性化與權力下放等趨勢,促使吾人必須更審慎的檢視公共服務形成之來龍去脈及其合法性、正當性與倫理性。然而,面對內外在環境之驟變,公共行政理論與實務界在新舊更迭之際似乎顯得束手無策;且此驟變產生了更多公共行政前所未有且治絲益棼之倫理議題與挑戰。
基此,本論文將建構具有融通、對立與競逐概念之研究架構,以揭露公共行政與公共政策研究中倫理議題複雜與弔詭之特性。此外,面對刻正發生的變遷與挑戰,若能在複雜多變的環境中找到簡單且有意義的邏輯與法則,將有助於在渾沌中找到秩序,以俾益理論與實務之開展。具體言之,本論文將透過美國學者Robert Denhardt等人(2007)提出的三種治理模式(governance models):古典公共行政(Old Public Administration)、新公共管理(New Publicment)與新公共服務(New Public Service)三種治理模式為架構,針對不同治理模式之下行政倫理之發展與觀點,進行分析、歸納與整合;以理解不同治理模式下行政倫理之「民主理論規範基礎」、「組織策略、結構與相應之倫理價值觀」、「倫理學取向」以及不同治理模式之「倫理限制與挑戰」,並據以得出具備全觀性與應用性的行政倫理觀點與結論。
綜上所言,本論文各章之內容概述如下:
第一章緒論,說明本論文之研究背景與問題意識、研究動機與研究目的、基本概念之界定、研究方法與章節安排。
第二章古典公共行政治理模式與倫理發展,將由代議式民主(representative democracy)理論出發,說明該模式下公共行政採取科層官僚治理之組織策略與組織結構,並據以推導出其倫理價值與倫理學取向,及該模式之倫理限制與挑戰。
第三章新公共管理治理模式與倫理發展,將由法律民主(legal democracy)理論出發,說明該模式下公共行政採取市場治理之組織策略與組織結構,並推導出其倫理價值與倫理學取向,及該模式之倫理限制與挑戰。
第四章新公共服務治理模式與倫理發展,將由審議式民主(deliberative democracy)理論出發,說明該模式下公共行政採取網絡互動治理之組織策略與組織結構,並推導出其倫理價值與倫理學取向,及該模式之倫理限制與挑戰。
第五章建構行政倫理全方位的思考與運用,本章針對以上三種行政倫理的限制與互補之處加以說明與論證;並透過不同治理模式行政倫理之意涵建立一分析與比較之競值架構,並透過它建構一面對倫理決策與倫理困境時之倫理判斷工具—倫理三角(ethical triangle),以作為全方位思考行政倫理與跨越三種行政治理模式之倫理限制與互補之方法。最後,本章將根據以上之結論,嘗試性的研擬出發展與促進倫理核心能力之方法、相關策略與制度化之規範,以建構倫理性的公共組織。
第六章結論,本章將以前五章之論證為基礎,針對行政倫理的性質及本論文運用之方法論之基礎加以檢視;並提出論文之研究限制與對後續研究之建議。
本論文希望透過行政治理模式下倫理發展之研究,能不同於以往研究之呈現方式,並期望研究成果能提供公共服務人員決策與行政之參考,以增進公眾信任與政府廉能。

ABSTRACT:
Public administrators have become increasingly aware the changing nature of public service. The rapidly changing external environment-marketization, globalization and cybertechnology-has greatly affected the values and management philosophies of public service. Likewise, changes in the internal environment of public service-privatization, flexibility and devolution-require rethinking of who provides services and how they are delivered. As a result, public administration-in theory and practice-has sagged under the strain and raises new administrative and ethical issues.
These challenges are needed a structured framework that reveals the ethical complexity, contradiction and competition in public administration and policy. Therefore, this thesis concerns about the development and transformation of public administrative ethics, and develops the three models of democratic governance (Denhardt & Denhardt, 2007)-Old Public Administration, New Public Management and New Public Service-as a framework to organize and compare different kinds of ethical values and issues in three competing models. Each model has four concepts: normative foundations of democratic value (representative democracy, legal democracy and deliberative democracy); organizational strategies, structure and the development and transformation of ethical values; approach of ethics (deontological, teleological and virtue ethics theory); and the ethical limitations and challenges of each model. The ethical tension in three models is real, but so is the mutual support.
The author hopes this study is helpful for public administrators in making ethical decisions and can provide a practical guidance that enhance the integrity and trust of public service. Specifically, the author links democratic governance theory, public organizational theory and ethics theory to improve the capacity in analysis and resolution of ethical issues of public administration and policy. The author also hopes this study can bring some new ideas for those who interested in fields about democratic governance, public administration and public administrative ethics.
