本研究以大陸船舶越界盜採海砂事件為例，目的在探討盜採海砂對我國海域環境破壞與海事安全之影響，並兼論金廈海域執法能量是否足夠。透過文獻分析、專家意見調查，以及深度訪談等研究方法，深入分析我國海域環境的破壞狀況、對海事安全之影響，以及我國在金廈海域的執法能量是否充足。研究結果發現，盜採海砂案件對金廈海域環境破壞與海事安全影響嚴重，以及金廈海域執法困境有待兩岸攜手共同突破。本研究並依據上述研究發現，提供以下之研究建議：在政策面上建立海巡機關專業形象；在法律面上制定適法專則；在執法面上強化執法效能、統合區域職權、增加執法能量、解決扣留船舶之收容問題。

This study took the case of mainland China vessels carrying illegal sand mining beyond boundary limits for example. In the paper, the author tried to explore the influence of the marine environmental deterioration and maritime safety from mainland China vessels carrying illegal sand mining and whether the maritime enforcement on the Kinmen-Xiamen waters is capable for combating the illegal sea sand mining by mainland boats. Based on analysis of documents, opinions from the experts, and interviews, the author majored on the marine environmental deterioration and the influence of maritime safety, and the author also tried to explore whether the maritime enforcement on the kinmen-Xiamen waters is capable for combating the illegal sea sand mining by mainland boats. Then, it found out that illegal sea sand mining in Kinmen-Xiamen waters has brought negative effects to marine environment and maritime safety. Moreover, Cross-strait cooperation is required for effective legal enforcement. In conclusion, the author suggests five ways to study on. Firstly, the need to maintain the professional image of the CGA. Secondly, the need for a specific legislation on the enforcement. Thirdly, the need to strengthen the enforcement capacity. Fourth, the need to regional integration competence. And the last, the need to enhance the legal enforcement.
